Z\u00e1kon v\u0161ak p\u0159\u00edmo jmenuje \u0159adu staveb, do kter\u00fdch se m\u016f\u017eete pustit <\/span><b>jak bez stavebn\u00edho povolen\u00ed, tak bez ohl\u00e1\u0161en\u00ed stavby.<\/b><span style=\"\"> Pl\u00e1nujete-li realizaci plotu, baz\u00e9nu, sklen\u00edku \u010di d\u00edlny, nebo v\u00e1s \u010dek\u00e1 rekonstrukce star\u0161\u00edho domu, mo\u017en\u00e1 se kontaktu s \u00fa\u0159edn\u00edm \u0161imlem \u00fapln\u011b vyhnete. <\/span><b>Mus\u00edte v\u0161ak splnit p\u0159esn\u011b dan\u00e1 pravidla.<\/b><span style=\"\"> V opa\u010dn\u00e9m p\u0159\u00edpad\u011b se bude jednat o \u010dernou stavbu, kter\u00e1 v\u00e1m m\u016f\u017ee do budoucna p\u0159in\u00e9st spoustu starost\u00ed. Na co si d\u00e1t pozor a kdy m\u016f\u017eete b\u00fdt v klidu? \u010ct\u011bte d\u00e1l.<\/span><\/p>\n<h2><b>Rekonstruujete? Na \u00fa\u0159ad mo\u017en\u00e1 nemus\u00edte<\/b><\/h2>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Pl\u00e1nujete <\/span><a href=\"https:\/\/www.wachal.cz\/reference\/rekonstrukce-mestanskeho-domu-v-prachaticich\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"\">rekonstrukci domu<\/span><\/a> <span style=\"\">nebo<\/span><b> rekonstrukci bytu<\/b><span style=\"\"> a l\u00e1mete si hlavu, jestli se p\u0159ed zah\u00e1jen\u00edm prac\u00ed vydat na stavebn\u00ed \u00fa\u0159ad? V p\u0159\u00edpad\u011b stavebn\u00edch prac\u00ed z\u00e1vis\u00ed na jejich rozsahu, respektive na tom, do jak\u00e9 m\u00edry ovlivn\u00ed budouc\u00ed podobu stavby.<\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Pokud se p\u0159i rekonstrukci obejdete<\/span><b> bez z\u00e1sahu do nosn\u00e9 konstrukce, zm\u011bny vzhledu nebo zp\u016fsobu u\u017e\u00edv\u00e1n\u00ed stavby<\/b><span style=\"\">, nebudete pot\u0159ebovat ani <\/span><a href=\"https:\/\/www.wachal.cz\/stavebni-povoleni-v-roce-2020-na-co-se-pred-stavbou-domu-pripravit\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"\">stavebn\u00ed povolen\u00ed<\/span><\/a><span style=\"\">, ani ohl\u00e1\u0161en\u00ed stavby. Sou\u010dasn\u011b nesm\u00ed m\u00edt stavebn\u00ed \u00fapravy negativn\u00ed <\/span><b>dopad na po\u017e\u00e1rn\u00ed bezpe\u010dnost<\/b><span style=\"\">. Pokud v\u0161ak budete cht\u00edt nap\u0159\u00edklad zm\u011bnit barvu fas\u00e1dy, posunout okna, nebo zas\u00e1hnout do nosn\u00fdch st\u011bn pro mont\u00e1\u017e posuvn\u00fdch dve\u0159\u00ed, bez n\u00e1v\u0161t\u011bvy stavebn\u00edho \u00fa\u0159adu se neobejdete.<\/span><\/p>\n<h2><b>Malou k\u016flnu nebo d\u00edlnu postav\u00edte i bez formalit<\/b><\/h2>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">V p\u0159\u00edpad\u011b mal\u00fdch objekt\u016f (d\u00edlen, k\u016flen, sklad\u016f, zahradn\u00edch domk\u016f, p\u0159\u00edst\u0159e\u0161k\u016f) z\u00e1le\u017e\u00ed na velikosti a um\u00edst\u011bn\u00ed. Pokud se chcete zcela vyhnout kontaktu se stavebn\u00edm \u00fa\u0159adem a postavit objekt bez jak\u00fdchkoliv formalit, mus\u00edte jej <\/span><b>um\u00edstit na pozemku rodinn\u00e9ho domu nebo stavby pro rodinnou rekreaci<\/b><span style=\"\">. Podle z\u00e1kona m\u016f\u017eete na takov\u00e9m pozemku, nap\u0159. p\u0159i <\/span><a href=\"https:\/\/www.wachal.cz\/jak-si-naplanovat-zahradu\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"\">pl\u00e1nov\u00e1n\u00ed zahrady<\/span><\/a><span style=\"\">, um\u00edstit stavbu do 25 m<\/span><span style=\"\">2 <\/span><span style=\"\">zastav\u011bn\u00e9 plochy a do v\u00fd\u0161ky 5 metr\u016f s jedn\u00edm nadzemn\u00edm podla\u017e\u00edm a podsklepen\u00edm do hloubky a\u017e 3 metry.<\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">U staveb do 25 m<\/span><span style=\"\">2<\/span><span style=\"\">, kter\u00e9 nele\u017e\u00ed na pozemku rodinn\u00e9ho domu nebo rekrea\u010dn\u00edho objektu, plat\u00ed podobn\u00e9 podm\u00ednky. Ani ty nevy\u017eaduj\u00ed stavebn\u00ed povolen\u00ed \u010di ohl\u00e1\u0161en\u00ed. V tomto p\u0159\u00edpad\u011b se v\u0161ak n\u00e1v\u0161t\u011bv\u011b \u00fa\u0159adu zcela nevyhnete. Budete toti\u017e pot\u0159ebovat <\/span><b>rozhodnut\u00ed o um\u00edst\u011bn\u00ed stavby<\/b><span style=\"\">, kter\u00e9 je v \u00fazemn\u00edm \u0159\u00edzen\u00ed prvn\u00edm krokem k povolen\u00ed v\u011bt\u0161iny staveb.\u00a0<\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Z\u00edsk\u00e1n\u00ed \u00fazemn\u00edho rozhodnut\u00ed b\u00fdv\u00e1 zpravidla rychl\u00e9 a bezprobl\u00e9mov\u00e9. <\/span><b>Z\u00e1kon v\u0161ak stanovuje dal\u0161\u00ed pravidla<\/b><span style=\"\"> \u2013 mus\u00ed j\u00edt o stavbu nepodsklepenou, bez obytn\u00fdch a pobytov\u00fdch m\u00edstnost\u00ed, bez hygienick\u00fdch za\u0159\u00edzen\u00ed \u010di vyt\u00e1p\u011bn\u00ed. M\u00e1te-li nap\u0159\u00edklad v pl\u00e1nu um\u00edstit do zahradn\u00ed chatky i postel a p\u0159\u00edle\u017eitostn\u011b ji vyu\u017e\u00edvat k p\u0159esp\u00e1v\u00e1n\u00ed, budete pot\u0159ebovat ohl\u00e1\u0161en\u00ed stavby.<\/span><\/p>\n<h2><b>Baz\u00e9n, sklen\u00edk, plot a dal\u0161\u00ed drobn\u00e9 stavby<\/b><\/h2>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Majitel\u00e9 rodinn\u00fdch dom\u016f \u010dasto \u0159e\u0161\u00ed, mohou-li na sv\u00e9m pozemku postavit zapu\u0161t\u011bn\u00fd baz\u00e9n, ani\u017e by o tom dali v\u011bd\u011bt m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00fdm \u00fa\u0159ad\u016fm. Dle stavebn\u00edho z\u00e1kona m\u016f\u017eete na zastav\u011bn\u00e9m stavebn\u00edm pozemku rodinn\u00e9ho domu nebo rekrea\u010dn\u00edho objektu postavit <\/span><b>baz\u00e9n a\u017e do 40 m<\/b><b>2<\/b><b> zastav\u011bn\u00e9 plochy<\/b><span style=\"\">. Na \u00fa\u0159ad nemus\u00edte v\u016fbec, proto\u017ee nepot\u0159ebujete ani ohl\u00e1\u0161en\u00ed, ani \u00fazemn\u00ed rozhodnut\u00ed. Budete-li cht\u00edt postavit v\u011bt\u0161\u00ed baz\u00e9n, p\u0159\u00edpadn\u011b m\u00e1-li b\u00fdt um\u00edst\u011bn\u00fd m\u00e9n\u011b ne\u017e 2 metry od hranice sousedn\u00edho pozemku, na \u00fa\u0159ad mus\u00edte. V takov\u00e9m p\u0159\u00edpad\u011b bude sta\u010dit \u00fazemn\u00ed souhlas.<\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Staveb, na kter\u00e9 se nevztahuje povinnost \u00fazemn\u00edho souhlasu, ohl\u00e1\u0161en\u00ed \u010di stavebn\u00edho povolen\u00ed, je mnohem v\u00edce. Podrobn\u011b jsou vyps\u00e1ny v \u00a779 odst. 2 z\u00e1kona \u010d. 183\/2006 Sb. Pat\u0159\u00ed mezi n\u011b nap\u0159\u00edklad:<\/span><\/p>\n<ul>\n<li style=\"\"><span style=\"\">Op\u011brn\u00e9 zdi do v\u00fd\u0161ky 1 metr nebo oplocen\u00ed do v\u00fd\u0161ky 2 metry<\/span><\/li>\n<li style=\"\"><span style=\"\">Sklen\u00edky do 40 m<\/span><span style=\"\">2<\/span><span style=\"\"> a v\u00fd\u0161ky maxim\u00e1ln\u011b 5 metr\u016f<\/span><\/li>\n<li style=\"\"><span style=\"\">Cirkusov\u00e9 stany a sc\u00e9nick\u00e9 stavby pro film, divadlo nebo televizi<\/span><\/li>\n<li style=\"\"><span style=\"\">Prodejn\u00ed st\u00e1nky um\u00edst\u011bn\u00e9 po dobu maxim\u00e1ln\u011b 30 dn\u00ed<\/span><\/li>\n<li style=\"\"><span style=\"\">Povrchov\u00e9 rozvody nebo odvody vody na zem\u011bd\u011blsk\u00e9 p\u016fd\u011b<\/span><\/li>\n<li style=\"\"><span style=\"\">Sto\u017e\u00e1ry pro vlajky do v\u00fd\u0161ky 8 metr\u016f<\/span><\/li>\n<\/ul>\n<h2><b>I pro stavby bez povolen\u00ed plat\u00ed jasn\u00e1 pravidla<\/b><\/h2>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Je t\u0159eba zd\u016fraznit, \u017ee i pro stavby, kter\u00e9 lze um\u00edstit bez jak\u00e9koliv komunikace se stavebn\u00edm \u00fa\u0159adem, plat\u00ed jasn\u011b dan\u00e1 pravidla. V\u0161echny stavby <\/span><b>mus\u00ed b\u00fdt v souladu s platn\u00fdm \u00fazemn\u00edm pl\u00e1nem<\/b><span style=\"\"> a mus\u00ed respektovat po\u017eadavky stanoven\u00e9 p\u0159\u00edslu\u0161n\u00fdmi p\u0159edpisy. Problematick\u00e9 je zejm\u00e9na um\u00eds\u0165ov\u00e1n\u00ed staveb v nezastav\u011bn\u00e9m \u00fazem\u00ed. Zde je mo\u017en\u00e9 um\u00eds\u0165ovat stavby pouze pro zem\u011bd\u011blstv\u00ed, lesnictv\u00ed apod.<\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Co to pro v\u00e1s znamen\u00e1 v praxi? I kdy\u017e na stavbu mal\u00e9 d\u00edlny do rozlohy 25 m<\/span><span style=\"\">2 <\/span><span style=\"\">nepot\u0159ebujete ani \u00fazemn\u00ed souhlas, ani ohl\u00e1\u0161en\u00ed, <\/span><b>neznamen\u00e1 to, \u017ee ji m\u016f\u017eete um\u00edstit v\u0161ude<\/b><span style=\"\">. P\u0159i um\u00edst\u011bn\u00ed do nezastav\u011bn\u00e9ho \u00fazem\u00ed, nap\u0159\u00edklad na louku nebo zem\u011bd\u011blskou p\u016fdu, byste mohli tvrd\u011b narazit.<\/span><\/p>\n<h2><b>\u010cern\u00e1 stavba v\u017edy nad\u011bl\u00e1 v\u00edce \u0161kody ne\u017e u\u017eitku<\/b><\/h2>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Pokud si nejste zcela jisti, pot\u0159ebujete-li k pl\u00e1novan\u00e9mu stavebn\u00edmu z\u00e1m\u011bru n\u011bjak\u00e9 stanovisko, na stavebn\u00ed \u00fa\u0159ad se obra\u0165te s dotazem. Pokud na sv\u00e9m pozemku postav\u00edte \u010dernou stavbu (a\u0165 u\u017e v\u011bdom\u011b, nebo nev\u011bdom\u011b), riskujete velk\u00e9 probl\u00e9my do budoucna. <\/span><b>\u010cern\u00e9 stavby se neproml\u010duj\u00ed<\/b><span style=\"\">, a tak mohou \u00fa\u0159ady zah\u00e1jit \u0159\u00edzen\u00ed o jejich odstran\u011bn\u00ed t\u0159eba i po mnoha letech nebo desetilet\u00edch.<\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\"><b>Za realizaci \u010dern\u00e9 stavby hroz\u00ed i vysok\u00e9 pokuty<\/b><span style=\"\">. Za poru\u0161en\u00ed povinnosti z\u00edskat \u00fazemn\u00ed rozhodnut\u00ed nebo souhlas m\u016f\u017ee \u00fa\u0159ad ulo\u017eit pokutu a\u017e 500 000 K\u010d. Pust\u00edte-li se do stavby bez pot\u0159ebn\u00e9ho stavebn\u00edho povolen\u00ed nebo ohl\u00e1\u0161en\u00ed stavby, riskujete pokutu a\u017e 1 000 000 K\u010d. Fyzick\u00fdm nepodnikaj\u00edc\u00edm osob\u00e1m lze ulo\u017eit pokutu jen do 1 roku od realizace.<\/span><\/span><\/p>\n<p style=\"\" class=\"wp-block-paragraph\"><span style=\"\">Na\u0161e stavebn\u00ed firma VW Wachal db\u00e1 na dodr\u017eov\u00e1n\u00ed \u00fa\u0159edn\u00edch formalit u v\u0161ech realizovan\u00fdch projekt\u016f.
